Agreement to Terms

By accessing or using BookedUp ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

Description of Service

BookedUp provides an online patient request capture and scheduling platform designed for dental practices. The Service allows:

• Patients to submit appointment requests online 24/7
• Dental practices to review and approve requests
• Multi-channel deployment (website, Google Business, social media, QR codes)
• Dashboard management of patient requests

Important: BookedUp is a request capture tool. You maintain full control to review and approve each request before scheduling.

Account Registration and Eligibility

• You must be at least 18 years old to use the Service
• You must be authorized to bind your dental practice to these terms
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities under your account
• One account per dental practice or location

Subscription and Billing

Free Trial

• We offer a 30-day free trial for new accounts
• A valid payment method is required to start the trial
• You will not be charged during the trial period
• Cancel anytime during the trial to avoid charges

Paid Subscriptions

• Monthly plan: $59/month, billed monthly
• Annual plan: $49/month ($588/year), billed annually
• All fees are in USD and exclude applicable taxes
• Subscriptions auto-renew unless cancelled
• Payment is processed through Stripe

Cancellation and Refunds

• You may cancel your subscription at any time from your dashboard
• Cancellations take effect at the end of the current billing period
• No refunds for partial months or unused time
• Annual subscriptions are non-refundable after the trial period
• We reserve the right to modify pricing with 30 days notice

Your Responsibilities

Compliance

You agree to:

• Comply with all applicable laws, including HIPAA and healthcare regulations
• Ensure patient data is handled according to your legal obligations
• Review and verify all patient requests before scheduling
• Maintain appropriate security measures for accessing the Service
• Use the Service only for lawful dental practice purposes

Prohibited Uses

You may not:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the Service or systems
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated scripts or bots to access the Service
• Resell or redistribute the Service without authorization
• Violate any intellectual property rights

Data and Privacy

• Our Privacy Policy governs the collection and use of your information
• You own all patient data submitted through your booking forms
• We may use aggregated, anonymized data for analytics and improvement
• You grant us permission to display your practice name and booking link
• You are responsible for HIPAA compliance in your use of patient data

Intellectual Property

The Service, including all content, features, and functionality, is owned by BookedUp and protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your dental practice during your subscription period.

Service Availability and Support

• We strive for 99.9% uptime but do not guarantee uninterrupted access
• Scheduled maintenance will be communicated in advance when possible
• Support is available via email at support@letsgetbookedup.com
• We may modify, suspend, or discontinue features with notice

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID IN THE LAST 12 MONTHS
• WE ARE NOT RESPONSIBLE FOR SCHEDULING ERRORS OR PATIENT COMMUNICATION
• WE ARE NOT LIABLE FOR HIPAA VIOLATIONS ARISING FROM YOUR USE

Indemnification

You agree to indemnify and hold harmless BookedUp from any claims, damages, or expenses arising from your use of the Service, violation of these terms, or violation of any rights of another party.

Termination

We may suspend or terminate your access to the Service:

• For violation of these Terms of Service
• For non-payment of fees
• For fraudulent or illegal activity
• At our discretion with or without cause (with refund of unused time)

Upon termination, your access will cease and your data will be deleted within 30 days.

Dispute Resolution

• These terms are governed by the laws of the United States
• Disputes will be resolved through binding arbitration
• You waive the right to participate in class action lawsuits
• Informal resolution will be attempted before arbitration

Changes to Terms

We may modify these Terms of Service at any time. Material changes will be communicated via email or through the platform. Continued use after changes constitutes acceptance of the new terms.
